Acceptable Use Policy

1. Purpose

This Acceptable Use Policy ("AUP") governs the use of the FlexiDuka platform by merchants and users. It defines permitted and prohibited activities to ensure a safe, lawful, and trustworthy platform for all participants.

By using FlexiDuka, you agree to comply with this AUP in addition to our Terms of Service and Privacy Policy.

2. Permitted Uses

FlexiDuka is a Software-as-a-Service (SaaS) platform designed to help businesses create and manage online storefronts.

Merchants may use the platform to:

  • Create and manage online stores.
  • List products or services they lawfully own or are authorized to provide.
  • Communicate with customers regarding orders, fulfilment, and support.
  • Connect and manage their preferred payment methods in accordance with applicable laws and payment provider requirements.
  • Promote and operate their businesses in a truthful and transparent manner.

FlexiDuka provides software tools only and does not act as a marketplace, payment processor, fulfilment provider, or financial intermediary.

3. Prohibited Products and Services

Merchants may not use FlexiDuka to sell, promote, or facilitate the sale of:

  • Illegal goods or services prohibited by applicable law.
  • Counterfeit products or goods that infringe intellectual property rights.
  • Weapons, firearms, explosives, or related items where prohibited by law.
  • Illegal drugs, narcotics, or controlled substances.
  • Adult or sexually explicit content.
  • Gambling services or betting activities without the required licences.
  • Wildlife products prohibited under conservation laws.
  • Financial scams, pyramid schemes, or unlicensed financial products.
  • Stolen goods or unauthorized digital content.
  • Content that promotes hatred, violence, or discrimination.

FlexiDuka reserves the right to remove content or suspend accounts involved in prohibited activities.

4. Prohibited Conduct

Users may not:

  • Engage in fraud, deception, or misrepresentation.
  • Publish misleading product information or pricing.
  • Collect or store customer payment credentials outside authorized payment providers.
  • Send spam, phishing messages, or unsolicited communications.
  • Attempt unauthorized access to accounts, systems, or data.
  • Upload malware, viruses, or malicious code.
  • Use automated tools to scrape or extract data without permission.
  • Circumvent security features or platform restrictions.
  • Use the platform to launder money or facilitate illegal financial activities.

5. Merchant Responsibility

Each merchant is solely responsible for all products, services, and activities conducted through their storefront.

This includes:

  • Obtaining all required licences and permits.
  • Complying with applicable laws and regulations.
  • Managing shipping, fulfilment, and customer support.
  • Handling refunds, returns, and disputes with customers.
  • Maintaining accurate product information and pricing.
  • Complying with consumer protection and data protection laws.

FlexiDuka does not hold customer funds, process payouts, or settle transactions on behalf of merchants. Merchants retain full control over their payment channels and customer transactions.

6. Reporting Violations

If you believe content or activity on FlexiDuka violates this policy, please contact us at support@flexiduka.com.

We may investigate reported violations and take appropriate action.

7. Enforcement

FlexiDuka reserves the right to:

  • Issue warnings for policy violations.
  • Remove prohibited content.
  • Temporarily suspend accounts pending investigation.
  • Permanently terminate accounts that repeatedly or seriously violate this policy.
  • Cooperate with law enforcement or regulatory authorities where required by law.

FlexiDuka may take enforcement action without prior notice where necessary to protect users, the platform, or comply with legal obligations.

8. Payment Provider Compliance

Merchants are responsible for complying with the terms and requirements of any payment providers they choose to use.

FlexiDuka may integrate with third-party payment providers for technical purposes only and does not process, hold, or transfer customer funds.

Any disputes relating to payments, chargebacks, or refunds remain the responsibility of the merchant and the applicable payment provider.

9. Changes to This Policy

We may update this Acceptable Use Policy from time to time to reflect changes in laws, regulations, or platform features.

Continued use of FlexiDuka after changes take effect constitutes acceptance of the updated policy.
